MUSKOGEE , OK —Sheldon J. Sperling, United States Attorney for the Eastern District of Oklahoma, announced today that his office has concluded the prosecution phase of a large drug distribution investigation. “This prosecution involved one of the largest illicit controlled substance networks in east central Oklahoma ,” U.S. Attorney Sperling observed. “Recently secured guilty pleas eliminated the need for the jury trial that would have taken most of the month of September to complete.”

“The trial was originally scheduled to begin September 8, 2008 , in the Federal District Court for the Eastern District of Oklahoma. The Indictment in the case was returned on March 12, 2008 . Federal prosecutors charged ten men and four women with conspiracy to possess with intent to distribute and distribute methamphetamine, cocaine, cocaine base and marijuana. Although the conspiracy was primarily based in Eufaula , Oklahoma ,” U.S. Attorney Sperling said. “it did business in a large area including Oklahoma City, Oklahoma, Fort Smith, Arkansas, and as far north as the area around Grand Lake of the Cherokees.”

“The investigation began in 2005. Assistant U.S. Attorney Rob Wallace led the prosecution. Agents from the Oklahoma Bureau of Narcotics focused on the Grand Lake area. They found the source of the drugs they were purchasing to be Eufaula. At the same time, agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Federal Bureau of Investigation teamed with Detectives from the Muskogee Police Department’s Special Investigations Division to begin making illegal drug purchases in the Checotah area. They found the source of the drugs they were buying to also be from Eufaula. The two investigations were combined into a single operation coordinated by the Organized Crime Drug Enforcement Task Force (OCDETF) of the Eastern District of Oklahoma. OCDETF is an initiative led in and coordinated by the Office of the United States Attorney.”

The twenty-eight count indictment returned by the grand jury in March named the following defendants:

JOHNNY EDWARD SMITH , a/k/a “Tick”, age 31, of DOC, OSP, McAlester . SMITH was the leader of this organization, which consisted of approximately fifteen individuals subject to his direct management. On three separate occasions, 11/21/06 , 1/4/07 , and 3/16/07 , SMITH sold drugs to undercover agents or individuals.

TERESA LOU MARTIN , a/k/a “Coo”, age 21, of Eufaula , Oklahoma . MARTIN is the girlfriend of SMITH. On 4/6/06 , 11/21/06 , and 9/13/06 , MARTIN arranged for the distribution of drugs either by directly distributing them to undercover agents or by obtaining the drugs and giving them to another co-conspirator for distribution. Martin is currently charged with manslaughter in connection with the stabbing death of Sheena Denice Shaver, who was killed in Osborn Park , in Eufaula. The manslaughter case remains pending in the District Court of McIntosh County, Oklahoma.

SEAN WARRIOR , a/k/a “Fat Boy”, age 26, of DOC, OSP, McAlester . WARRIOR, assisted by NATHAN DEVON SIMMONS and/or DANUEL JUNIOR DYER, delivered drugs to undercover agents on three separate occasions, twice on 7/22/05 and once on 9/1/05 .

NATHAN DEVON SIMMONS , age 31, of Muskogee , Oklahoma . SIMMONS, assisted by SEAN WARRIOR and/or DANUEL DYER, delivered drugs to undercover agents on two separate occasions: 7/22/05 and 9/1/05 .

DANUEL JUNIOR DYER , age 24, of Tulsa , Oklahoma . DYER, assisted by SEAN WARRIOR and/or NATHAN SIMMONS, delivered drugs to undercover agents on three separate occasions, twice on 7/22/05 and once on 9/1/05 . DYER also acted as a look-out and gave cover to SEAN WARRIOR during drugs deliveries.

MILTON TRAVIS WARRIOR , age 24, of DOC, OSP, McAlester . MILTON WARRIOR sold drugs on numerous occasions to undercover agents. Searches of Warrior’s Checotah , Oklahoma , residence, pursuant to separate State and Federal search warrants, resulted in the seizure of large amounts of drugs and numerous firearms.

PHILLIP JEROME WARRIOR , a/k/a P.J. Warrior, age 31, of Eufaula , Oklahoma . PHILLIP WARRIOR sold drugs to undercover agents on 9/13/06 .

OCQUINETTA ALICIA DAN , age 29, of Muskogee , Oklahoma . DAN is SMITH’s cousin. DAN coordinated travel arrangements for the members of this drug trafficking organization, who regularly took trips to luxury resorts both in and outside the United States .

JEREMY SHANE WOODARD , age 35, of Eufaula , Oklahoma . JEREMY WOODARD is a co-conspirator who distributed drugs to an undercover agent on two occasions, 3/1/07 and 3/8/07 .

JULIAN DARNELL WOODARD , age 31, of DOC, OSP, McAlester . On 3/9/07 , JULIAN WOODARD was found in possession of 114.17 grams of cocaine base, 76.09 grams of cocaine powder, 370.67 grams of methamphetamine, and over $8,050.00 in cash attributable to this organization.

OLYMPIA DENISE CALDWELL , age 27, of Muskogee , Oklahoma . CALDWELL facilitated the payment of money for travel arrangements for the organization.

CLARENCE LEE PIERCE, III , a/ka/ Three, age 32, of Muskogee , Oklahoma . PIERCE sold methamphetamine to an undercover agent on 6/6/06 and 6/23/06 .

UNA NISHETTA SMITH , age 63, of Eufaula , Oklahoma . UNA SMITH is JOHNNY SMITH’s aunt. She maintained a house in Eufaula where a large amount of drugs were seized during a search warrant. The house was a “stash house” for drugs moving in this organization.

VANCE EUGENE WINSLOW, III , age 34, of Checotah , Oklahoma . WINSLOW is a co-conspirator who participated in the distribution of drugs with MILTON WARRIOR.

“All defendants have entered guilty pleas to charges contained within the March 12, 2008 , indictment. A summary of the dates of plea and charges for each defendant follows:

8/1/08 

VANCE EUGENE WINSLOW, III, age 34, of Checotah , Oklahoma , pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C. Section 846.

The statutory range of punishment for Conspiracy is not less than 10 years nor more than life imprisonment and/or up to a $4,000,000.00 fine, and not less than five years supervised release. Preliminary sentencing guidelines, given known sentencing factors, project the defendant could be sentenced to 63—78 months imprisonment.

8/19/08 

PHILLIP JEROME WARRIOR, a/k/a P.J. Warrior, age 31, of Eufaula , Oklahoma , pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C. Section 846.

CLARENCE LEE PIERCE, III, a/k/a Three, age 32, of Muskogee . PIERCE pled guilty to the same Conspiracy charge as WARRIOR.

Preliminary sentencing guidelines, given known sentencing factors, and these defendants’ lack of criminal history, project the defendants could be sentenced to 37—46 months imprisonment.

8/22/08

JOHNNY EDWARD SMITH, JR., a/k/a Tick, a/k/a Little Johnny, age 31, of Eufaula , Oklahoma , pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C. Section 846.

Preliminary sentencing guidelines, given known sentencing factors, including the fact that the defendant was a leader/organizer, project the defendant could be sentenced to 360 months to Life imprisonment.

8/25/08

SEAN WARRIOR, a/k/a Fat Boy, age 27, and JEREMY SHANE WOODARD, age 35, both of Eufaula, Oklahoma, pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C., Section 846.

Preliminary sentencing guidelines, given known sentencing factors, for WARRIOR project the defendant could be sentenced to 168—210 months imprisonment. Preliminary sentencing guidelines for WOODARD project the defendant could be sentenced to 63—78 months imprisonment.

TERESA LOU MARTIN, a/k/a, “Coo” age 21, of Eufaula, McIntosh County, Oklahoma, along with, DANUEL JUNIOR DYER, age 24, of Tulsa, Oklahoma, pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C., Section 846.

OLYMPIA DENISE CALDWELL, age 27, of Muskogee, Oklahoma, who pled guilty to Engaging in Monetary Transactions in Property Derived from Specified Unlawful Activity, in violation of Title 18, U.S.C., Section 1957 and 2.

UNA NISHETTA SMITH, age 63, of Eufaula , Oklahoma , pleading guilty to Maintaining Drug Involved Premises, in violation of Title 21, U.S.C., Section 856(a)(2) and Title 18, U.S.C., Section 2.

The statutory range of punishment for MARTIN is a term of not less than 10 years no more than life imprisonment and/or $4,000,000.00 fine. SMITH faces not more than 20 years imprisonment and/or a fine of $500,000.00. CALDWELL could face a term of imprisonment of up to 10 years and/or a fine of up to $250,000

JULIAN DARNELL WOODARD, age 32, of DOC, OSP, McAlester, Oklahoma, pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C., Section 846.

A preliminary guideline review projects that WOODARD could face 121—151 months imprisonment.

9/5/08 

MILTON TRAVIS WARRIOR, age 24, of DOC, OSP, McAlester, Oklahoma, pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C., Section 846.

OCQUINETTA ALICIA DAN, age 29, of Muskogee, Oklahoma, pled guilty to Conspiracy to Possess with Intent to Distribute and Distribute Controlled Substances, in violation of Title 21, U.S.C., Section 846.

“The statutory range of punishment for each defendant is a term of not less than 10 years and no more than life imprisonment and/or a $4,000,000.00 fine,” recalled U.S. Attorney Sperling.

“All of the defendants are in the custody of the United States Marshall Service pending the completion of pre-sentencing reports. Individual sentencing hearings will be scheduled as the reports are completed.”
